NgugiDrive is an online platform that connects car buyers, sellers, and dealers in Kenya. The platform allows users to list vehicles, search for vehicles, communicate with each other, and complete transactions.

3. User Accounts

To use certain features of our platform, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate and complete information when creating an account

4. User Conduct

You agree not to:

• Post false, misleading, or fraudulent listings
• Impersonate another person or entity
• Harass, abuse, or harm other users
• Engage in any illegal or fraudulent activity
• Upload malicious code or content
• Interfere with the operation of the platform
• Attempt to gain unauthorized access to other users' accounts

5. Vehicle Listings

When listing a vehicle on NgugiDrive, you agree to:

• Provide accurate and truthful information about the vehicle
• Upload clear and accurate photos of the vehicle
• Disclose any known defects or issues with the vehicle
• Honor the price and terms stated in your listing
• Respond to inquiries from interested buyers in a timely manner
• Comply with all applicable laws and regulations

6. Transactions

NgugiDrive is a platform that connects buyers and sellers. We are not a party to any transaction between users. We do not guarantee the quality, safety, or legality of vehicles listed on our platform. Users are solely responsible for their transactions and should exercise due diligence.

7. User Content

By posting content on NgugiDrive, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your content in connection with our platform. You represent and warrant that you have the rights to the content you post and that it does not infringe on any third-party rights.

8. Fees and Payments

Certain features of NgugiDrive may require payment of fees. All fees are in Kenyan Shillings (KES) and are non-refundable unless otherwise stated. We reserve the right to change our fees at any time, with notice to users.

9. Reporting and Moderation

We encourage users to report suspicious activity, fraudulent listings, or inappropriate behavior. Reports can be made directly from the platform and are reviewed by the NgugiDrive trust and safety team. We reserve the right to suspend or terminate accounts found to be in violation of these terms.

10. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms of Service, fraudulent activity, or misuse of the platform.

11. Disclaimer of Warranties

NgugiDrive is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, NgugiDrive and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

13. Indemnification

You agree to indemnify and hold NgugiDrive harmless from any claims, losses, liabilities, damages, costs, and expenses arising from your use of the platform, your violation of these Terms of Service, or your violation of any third-party rights.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Kenya. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the platform after any changes constitutes acceptance of the new terms.
